Ok lets say that F1 is changed to a dual intent visa (Which i doubt will ever happen)

What ever your logic the fact is currently F1 is NOT and immigrant intent visa and hence there is fraud currently. Now what happens in future is not deterministic but what is happening now is plain to see

Thats what my question is. I think they just replied to cough up $5K from us.
This is just delaying techniques by USCIS. I think they are assuming that no one is going to pay this much amount and they can hide the BS they are doing!

Just like with individuals, we tend to place trust on organizations and instituitions based on their past behaviors / actions. It's obvious we have very little trust on USCIS.
I think there is some misunderstanding on the memo bein discussed.
I'm still betting USCIS has a (reasonably accurate--- give or take a thousand) tally of pending India / China EB2 I-485s that match the available GC visa numbers which have to be used up before Sep 30th. All they have to do is assign visa numbers before September 30th. It is quite possible for them to process the applications and assign the visa numbers at the end. Most likely approvals will come well into October.
Well, that's the way U and I would do it, so no visa numbers are wasted. It remains to be seen if the UscIs has more cooks than just U and I! ;-)

Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.
We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else�s small babies. She it seems had come here last year and taken care of someone else�s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old � who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child�s safety every day.

as many are aware, there was a huge rush to buy and sell pre-approved labors during july-august 2007, when all the priority dates were suddenly made current. Tens of thousands of labors were sold by fraudulent consulting companies to many questionable gc seekers, who hadn�t even started the process till then.
It is those substituted labors which are clogging the pipelines now. Just think, last month eb3-i stood at november 2001. Now it is completely unavailable. It can�t possibly be because so many pending labors with such old priority dates suddenly got cleared this month, and beneficiary of these labors filed 140+485 together. I seriously doubt that a candidate whose labor is pending since such a long time is even keeping that gc process alive. In all likelihood he/she must have moved on in life.
There is only one explanation. These labors were already pre-approved. It is the attached i-140 on these labors that are getting approved rapidly. And the subsequent i-485 petitions on these applications are depleting the visa numbers.
The reason of this post is not to start an argument about the ethics of labor substitution. It is just a fyi post to explain the seemingly inexplicable. The chickens are coming home to roost.

I joined IV only this month due to the July visa fiasco. I learned a lot from all the members and the IV core team. I haven't made any contribution so far. My husband who has a H4 visa just recently graduated from nursing school and finances are tight. Anyway, with this new development, hopefully my husband will be able to get a job with his EAD. We will be in a position to contribute to IV. Thank you again!!!

Since you have not applied this time...you cant get in this years Quota..so get an job where you can get h1 sponsorship next year..So take off to india once your opt is over...get the employer to get you the h1b papers once approves and start to work next 08 Oct1...

As per my ex-attorney I-485 receipt date holds edge over the PD....which is stupid to say the least....ideally it should PD FIFO but then again USCIS is anything but sane...
The 485 processing date is slower that India's 5 year plans...especially at TSC....
Also RFEs that some of my friends got are not so simple...one was asked for continued pay slips to show no break in job or in betwen jobs....had it been just a EVL things 'd have been much simpler.
In any case no RFE can be addressed and processed within 30 days...so anyone getting an RFE and who falls within the window meaning PD current will loose a chance....since in all probability Oct things will move back again....

Actually we were called for interview at the local uscis, : My RD was Aug-17-2007 and the ND is Oct-15-2007. The DAO - District Adjudication Offcier gave me a heart attack saying that we are not eligible for GC as the cut-off date was 17-Aug and we were out of the window. Then I politely explained her, and then she looked at the RD and said that we would be fine. Also I called USCIS last week, and told that I filed on Aug, one rep said that they go by ND, I called again and the other rep said that "by ND". Not sure, may be uscis itself is not sure.
Anyhow, is it advisable to take an infopass now (i.e) before september . Wouldn't it be better to visit uscis office in september, so that we could strongly say that "We are current, and could something be done about our case".
I'm afraid that, if we go to uscis now saying that "We will be current in Sep", the uscis people might ask us come back again in Sep. And remember, we cannot have two consecutive infopass within 45 day. So what do you suggest?

Understood dude, but the fact, Iam not questioning anyone's contributions here. Please understand one thing, I did not even question other members in this forum. It all started when i asked Admin2, What post accused admins in the "If i could be little blunt" thread. I did not even utter a single word or question him ? If you want you can ask Admin2. It is only after he said MadhuVJ and GCStatus are the same. I started this argument. Because to me, it was rubbish. Eversince, Iam only trying to clear this thing up. Even after that, I did not bad mouth him. Iam giving all my details just to make it clear to him that Iam not GCStatus. Hope you got my point. Infact, if you want to go to page 3 and start reading all my posts. Tell me, If i crossed my line in any of my posts.

Who would have been benefitted? YOU and ME and NOT Admin2.
