We do see such threads on the forum occasionally where the employee is being cheated/asked to sign a contract/is not being paid on bench/employer is threatening etc etc... There are several instances where members have posted negative comments about consulting companies and how employees are unhappy working for them.
Is this really true?
I want to understand the reasons why people are not filing lawsuits against such companies yet? Why are we not reporting them to DOL and USCIS? Especially after filing I485 and expiry of 6 months, people are in a better position to file lawsuits against such employers.
IV can help only if people are willing to be helped and ready to take action.
If this system needs to be cleansed, then why aren't we doing it?

Hi,
My H1 which was approved back in 2006 has been re-opened today...This is the status I see on USCIS web-site
Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending.
We reopened this I129 PETITION FOR A NONIMMIGRANT WORKER on April 26, 2009, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service.
I have used AC-21 and been working with new employer on EAD since April, 2008. I talked to my old employer and they said they have sent a request to withdraw my H-1B and all other immigration applications. So, I am assuming that they have also withdrawn 140. He also said when someone leaves the company its a normal process to withdraw all the immigration related documents.
Can you please tell me, what will happen to my cases. If someone has gone through the same, if they can share their experiece that will be really appreciated.

First of all Congratulations desi#### and thanks for continuing to support IV.
Interesting discussion going on. Yes, I agree that most of us here are waiting for our GC and some of them go on to become US Citizens.
I believe that becoming a citizen of any country is a person's choice, so let us not give desi### a hard time here.:o
But I certainly do not think it is an 'achievement' to get a US citizenship, just because it implies indirectly it is an 'achievement' to let go off Indian citizenship. Nothing meant to offend you desi#### but it hurts when one reads such a statement somewhere deep inside the mind. But hey, as I said earlier, to each his own and noone should be judging others in their decisions.
And it is not only Indians becoming US citizens every year. There are others too.
Personally, even with all the advantages as stated above of being a US citizen, I will never let go of my Indian passport. Even if the authorities give it to me tomorrow in a lottery;) Never.
Why? Because my identity, my rich heritage, my family roots, my parents, my culture everything is Indian and am proud of it. There are lot of sentimental and emotional attachments. I was going through the OCI articles today after reading this discussion.
It is not exactly a dual citizenship. Some clauses are no voting rights! No Indian Passport!
Getting a GC is another thing, but when I decide to go back after a couple of years, I would definitely want to retain my voting rights. ! I rest my case.
US citizenship is a final stop for most/many immigrants. Post Sep 11, there has been a surge in nationalization applications because technically GC is like a long term visa to stay permanently. Therefore there is always a risk of losing GC because of DUI or other trivial or accidental issues etc.
Also post Sep 11, a lot of govt/sensitive projects that were available for GC only have been restricted to US Citizens. You lose a significant chunk of the available jobs market if you are a GC holder in the Maryland/DC/North Virgina area. In fact I know a lot of GC who kept their old passports but because of these hassles eventually decided for Naturalization.

Finally my attorney from the previous company has received the withdrawal notice for my H1B with that company. The attorney also said that this was in response to the withdrawal request that the company has filed with USCIS after I left them.
Just the same way I had mentioned a couple of days before....

I had H1B valid up to 2010 (3 years extension because of I-140 being approved). Then I traveled abroad and entered US last December using AP. My new I-94 said "paroled in" and had an expiry date of Dec 2008 (till the date the AP was valid). Last week my company applied for transferring my H1B to one of it's subsidiaries as my position was transferred to the new subsidiary. They applied using premium processing and got an approval this week. My new H1 is valid for the next three years now (till 2011) :)
Also, although I entered US using AP I continued working using my old H1B. I did not use EAD. I talked to my attorney and according to them entering on AP does NOT automatically switch you to EAD. You can still keep on working on your original H1B. Since my H1B transfer was approved later I believe they are correct in this regard.

I might be wrong, but I think EB2 India came only uptil April 2004.
And the next month (July) EB2 India became current. That is when visa numbers were issued to already pcoessed Sep 2004 cases and approved.

It is not easy to tear apart a Green card - u need a sharp instrument - and be careful because u may hurt urself if u do it with the levels of frustration :) :)

Can you make what you wrote here in your reply in a form of a letter and create a petition to be signed by IV members ( just like this petition fighting Lou Dobbs). then your petition will be mailed to all media outlets. I really like what you wrote and I think if baked by IV we can sign it as a petition and send it to explain our cause to the media and the American people that might not be aware of our situation.

- Despite the fact that they pay taxes, social security etc
- They represent a continued American heritage of immigrants chasing the Great American Dream
While H1B workers might appear to 'displace US workers', the crux of the issue is that in order for US companies to remain innovative and competitive they cannot afford to take a hoary protectionist policy in talent management.
High skilled talent finds level ground, wherever it might be.
While the old world order was about national boundaries and international competition amongst countries, the new world order is about a flat world where transnational collaboration and commerce can enable wealth and job creation in any part of the world!
The presence of high skilled foreign workers INSIDE the US
- ensures that jobs remain in the US
- ensures that resultant taxes remain in the US
- ensures that resultant investments target the US economy
- apart from ensuring US competitive and commercial advantage
The oft repeated arguments about 'local talent being available but not tapped' is borne out of a sense of elitist entitlement; something that runs counter to the great American Dream and the quest for constant innovation, creation, improvement and execution.
The need of the hour should be on how to enable successful assimilation of high skilled labor and talent into the US economy such that the economic engines of efficient productivity are not hampered by artificial tarrifs and barriers borne out of a broken immigration system.
The quest for a color-blind, talent-oriented, country-agnostic immigration system has a long and sometimes troubling, history.
While the old world afforded the luxury of years to rectify imblances and imperfections in policy constructs, the new world leaves little room for inefficient alignment of policies.
The need to fix a broken legal immigration system is as much an economic reality as it is to address detrimental effects in womens' rights (spouses' rights), labor rights and free markets.

We have told several times, that we dont have time to keep everyone in loop about everything we do in DC, including every time we meet some staffer or someone. Sorry, that's just how it is.
Last week, Aman was in DC on Thursday and Friday (Jan 25 and 26) and had meetings with 3 senate staffers who work on Immigration. Then he went to India, then he came back straight to DC monday morning and since yesterday, he has met with 2 more staffers, our lobbyists.
We are also trying to find out about the schedule A rumor and if its true, to have the recaptured visas go to all categories not just schedule A.
So there, you have your update? If you want to know more, then call us on the phone.
And this update is the kind of update we dont usually post on forums. This is mundane advocacy stuff. Find me one organization that gives hour by hour update of what they are doing.

well, I have to keep my hopes up. Since I HAVE to wait to get H4 extension before I can apply for H1 transfer, I'd like to see them last long enough so that I can get an H1 IN time, this year.
It can be so disappointing to get the job but miss the quota for 2 consecutive years :mad: :mad: :mad: and then 2 years I was ineligible for H1 because of the 6 yr limit. :( :mad:
Anyway, every dog has its day and I am hoping this is the year when I get my H1. :D

It has been determined that based on the current level of demand being received, primarily by Citizenship and Immigration Services Offices, there would be otherwise unused numbers in the Employment Second preference category. As a result, numbers have once again become available to the India Employment Second preference category. The rate of number use in the Employment Second preference category will continue to be monitored, and it may be necessary to make adjustments should the level of demand increase substantially.
May be EB2 India and China can see some movement in July VB published in June.
