I have filed for H1B under the Masters quota but i will be graduating only in May and gave an official document from my University that i would be graduating. Somebody i know had also done a similar thing but he got a h1B rejection mail from USCIS yesterday. This has made me really upset. Is anyone there who has filed with a similar document and has received H1B? He had filed it witha consultant while mine is a highly reputed company. Will that make a difference?

Of course he is very informative, however he is very biased and having wrong openion that EB3 India has stolen EB3_ROW number in previous years as he belongs to ROW. He wrongly assumes that till EB3-ROW becomes current EB2 & EB3-India will not see any movement. He thinks no one knows the rules, laws ect..and he is only one knows everything. The actual fact is most peoples have been doing research on retrogression like him last two years and not having enough time to reply his post. To fuel his openion DOS is violating the section 202 of INA and no one cares about this including IV core team.

You should consider gathering a few more EB2 India guys and have a crack at suing USCIS for violating the law...Unfortunately I am EB3 India and this suing does not help me...
You can ask for GCs for all members of your law suits...But USCIS would fight you hard for sure...
IV is collective organization...IV's solution would be to get numbers increased for everyone...Otherwise we would again have a fight bet EB2 and EB3 link the one we had between guys who want the 485 without PD and those who oppose it...

-- Grass root & state level efforts work only when there are a lot of grass root workers. For example independence struggle in india worked due to grass root efforts. But please try to understand that things are different here --- by definition, we are immigrants, our numbers are limited in this country.
Simply put, groups working in isolated corners of the country are having no effect on the politicians, because each area has only a few people and the politicians are not seeing the combined effect.
"Grass root efforts" may sound very trendy, but are actually leading us no where............yes we need it......but at the same time IV has to have a strong leadership who can show their strenght by doing phone / lettere campaigns.

I didnot started this thread not blame anyone. Everyone knows IV is our only hope....sorry if it hurt someone.
All I wanted convey is that the current visa bulletin is an opportunity (just like jul 07), IV should try to take advantage of it. They made a mistake by putting in writing that USCIS can not estimate, lets use it to our full advantage.
Lesser mortals like myself can not do much...but surely IV core can.

Yes, but it is not the receipt generation, it is the actual review of the case as per advertised processing dates. if your case is in the Processing Date window (based on your online receive date), then most likely your case is preadjudicated, and now is waiting for the visa in sequence of PD. Best of luck.

You are ABSOLUTELY correct in saying that all the forums mention EB2 and very little attention is shed on EB3. I wonder why! Is it because EB2 recepients are more actively involved on IV? Or because EB3 recepients are quieter? Both these situations lend themselves to the bias towards EB2. And ultimately lead to one thing - more being done for EB2. I am EB2 and believe you me - I'm not complaining.
Sadly though, the number of EB3 applicants is many many times the number of EB2. So, there's something to be said for participation and having your voice heard. It is no wonder then that we as a group are dismal at having our collective voices heard - we don't participate like our lives depended on it. And in this case our entire lives depend on what's going on...
So, instead of bickering and blaming, why don't we awaken the giant that is EB3 India and China and have them participate as well...maybe we'll be able to kill many many birds (country limits, DC rallies, contributions to IV and lobbying activities, phone call campaigns, letter campaigns...) with just one stone....just thinking out loud...that's all...

Everyone in this forum knows that I am a complete moron: I did not even know ROW and Schedule A. So it does not make sense in paying attention to my advice. I still have the audacity to request everyone to pay more attention to the following.
Both sides have very valid points. A healthy debate on the topic is insightfull specially to morons like me. However, it is sad to see contributing members fighting over an issue that we may NOT have to resolve. I wish we had such a vigorous debate on generating contributions which will serve some purpose.
I agree Macaca. It never ceases to amaze me, how willing and ready everyone on here is to start a rousing argument over the smallest things instead of focussing on the main goal!

Denatured, looks like no one knows the exact answer. It's only the 2nd year we've had the lottery, and last year it was unexpected so not many people had 2 applications in.
If both of your H1s are approved, then I'd imagine you'd receive two approval notices with different company names on it. I believe you'd then have to choose which one you want to use for your visa stamp, and let the other company know you have to turn down their offer. I imagine they won't be happy about it, but it's your right and if you want to be ethical you can offer to refund their H1B filing fees.

I never claimed any amount for this holiday gift on this thread yet but what if I want to donate $31 or per say $ 81 one time, I do not have that option now and so I will end up not donating now and wait and donate when I feel comfortable with $ 100/- or its multiplications. That is called turning away and if you guys do not see any danger into it I do not have any further words.
Fund raising is an art and I believe our current startegy is lacking that art. If you guys see the base of any major successful fund raising (Grass root level not Political ones, mind well we claim ourselves grass root level organization)you will always find donors with $ 1 to donors with $1 million donatiing as per their will. Grass root level fund raisings can not afford constraints which normally goes successful in political and/or industrial fund raisings.
Some of the strong supporters of current policy, in their argument, automatically assume that willing donor always used to spend $ 100/- frequently for drinks or food and may be living lavish life style. But they are partly wrong in their assumption...I myself never eat outside frequently. Even on a travel trip I cook my food by myself and I normally do not drink sodas or alcohol so what abhijitp has given a example at least does not remain valid for me but I can not say that it is completely out of proportion, as it has some valid logic but it can not be true for everyone.
Point is if we make a wrong based fund raising policy, we may hurt ourselves only. I know my option, if I want to donate odd figure now, I will not be able to donate it now, and I will have to wait till I feel comfortable donating $ 100/- and/or single digit multiplications of $ 100/- but would that be considered a good and wise option?
For an example, I am emotionally charged today and I want to donate $ 61/-(As I may plan that much only..for whatever reasons) but I am not able to donate so I will not donate and say after 4 months I will be able to plan $ 100/- but what if at that time I may not be emotionally charged to donate all together? So end effect would be I will end up donating nothing ( This is just an example..:))
And for the sake of argument if you enrolled yourself $50/- recurring, you did it willingly and so would you change to $ 25/- recurring if $ 25/-option is available to you? But with current policy we are completely turning away the people who may otherwise donate, for an example $ 20/- monthly-recurring policy may turn 40 new commited donors in whereas $50/- recurring option is creating only 10 donors and thus we may be ending up $ 300/- confirmed donation loss per month. This is just an example and based on assumption that less amount would attract more commited donors.
Having said all this, if majority memebrs and core still feel that this will be the only future standard for accepting donations then as I mentioned above, I will have only one option left and that is to wait till I become comfortable for donating $ 100/- ( I will remain emotionally charged...:))
