Around the second week of each month, a welter of activity breaks out on the online forums of Immigration Voice, a non-profit organization set up by employment-based legal immigrants in the US. Users on the site vie with each other to predict the cut-off dates for the next month�s Visa Bulletin. These dates dictate the hopes and lives of thousands of legal immigrants and owing to their sheer numbers, Indian and Chinese applicants make up the overwhelming majority of those who wait in line for employment-based US permanent residence.
Since 200x, barring a few anomalous months, the cut-off dates have largely languished between 2003 and 2004. While the annual limit of per-country allocated visas for Indian and Chinese applicants are exceeded by the number of applicants, the problem is compounded by the ongoing inefficiency of the United States Citizenship and Immigration Services (USCIS). This inefficiency occurs at many levels of processing:
1) Slow processing times often leading to wasted visa numbers that expire at the end of the immigration year.
2) Lack of transparency throughout the process.
3) Lack of customer service in spite of regular ramping up of immigration fees.
4) Random movements, spanning months and sometimes, years, in the cut-off dates of the monthly visa bulletins.
5) Lack of communication between the USCIS and the Department of State (DOS) (the agency that sets the visa bulletin).
These are some of the most glaring inefficiencies that law-abiding, tax-paying immigrants suffer throughout the lengthy process which more often than not spans a minimum period of five years. However, the most egregious of the USCIS�s faults is the apparently complete cluelessness as to the number of applicants pending in their database. It boggles the mind how an agency of such import is unable to give a definite figure to the number of applications remaining to be adjudicated. That the United States, the most advanced country in economic and military leagues, can�t account for its legal immigrants speaks to the need for more highly-skilled immigrants to improve the status quo?

This ain't nothing. Wait until the second wave of labor substituted EB3 applicants port their case from EB3 to EB2 or EB1 .Talk about a double whammy. Except a bigger hit in the next year or two when most of the porting succeeds.

Are we still compiling or the stories have started going out to the right people. It was amazing to watch Sen FIenstein talk about a poor hardworking undocumented worker in the US. She was so eloquent. Every passing day makes u feel more like a 2nd class citizen. Anyways, let us chug on. I had sent my story. Pls let me know If you would any further action from the story senders like myself.

Just because there is not much happening in front of the media circus, do not for a moment believe nothing is happening behind the scenes.
The IV core members are still working and talking to senators and congressmen. In fact one of the core members of IV met with his congressmen today and it was a very productive meeting
The media team has also got some very important leads. Thanks to all the contributors of stories, we were able to immediately capitalize on an opportunity from a world renowned publication. We are hoping that this will be out soon.
Another US top-3 publication's article is in the works too.
As I had mentioned earlier, we have received quite a few stories and its encouraging to see people now willing to speak publicly and realizing that maybe it won't help, revealing one's story will not hurt for sure. Plus, we will never be able to conduct rallies like illegals. Approaching media with our stories is the only way to get ourselves heard.
Someone had asked a question that how many stories have we received. The answer is about 20. That might seem a lot but let me give you a very recent example of how this was too little.
We were approached by a award-winning reporter to provide her two members of IV that fit two criteria
1) Should be non-IT
2) EB1 or EB2
Given the 20 stories we had only 2 such folks that fit the criteria and they who were gracious and spoke to the reporter. The reporter then wanted to speak to one more person and we did not have any readily available person. So we had to do a crazy search for a person that fits this criteria. We were able to find someone at the last moment and we did not squander our chance. But chances are pretty high that such a thing can happen in future!
We might have a reporter who wants to write an article but is looking for an EB2 from the state of Texas. Currently we do not have anyone that fits the criteria. We would lose this chance which anyways are not easy to come by.
Also, when our IV core member met with the congressman today, he asked for someone who was suffering in his district. Fortunately our core member was from his dictrict and hence we were okay, else it would not have been a productive meeting!
So please please send us your stories......we will not reveal your info to anyone without your expressed permission. We promise....

Hi,
this is my first post...
I've seen most of you guys are indians, I admire you for being so organized and brave, and also for getting skilled enough to be sucessfull anywhere.
I'm not in the IT business, I'm not indian, I don't have special skills nor advanced dregrees. I'm just a regular guy who has worked all his life to achieve what he got. Since my degree is a 3 years old, I did not qualify foe EB2 even being in a managerial position for over 10 years.
I was waiting for the opportunity to file my family's I485 and then my company was bought and I was laid off on jun 14th.
I've been 6 years in this country, I have 2 american born kids, I've paid a lot of taxes, I have a house mortgage, a car loan...
Now I'm out of status and worst of all, everything on the GC process is lost.
I don't think it's fair, I've never done anything illegal, but I'm not ready to leave the country. I need to sell my property, don't know what to do with the car, my wife is on her MBA thesis, I just can't leave.
I'm telling all this not because I want you to feel sorry, but to create awareness that it's NOT on your hands being legal or illegal. You're in others hands: your employer, USCIS, the adjudicator officer.
So don't judge others just because you have been lucky enough to maintain your status...

What do u mean by genuine RFEs....
My RFE was to prove status from 1999 to 2003..show I-20/EAD/F1/H1 etc....
Regardless of RFEs what I meant was preadjudication is a myth....anyone can get an RFE whether he is preadjudicated or not....
U can get RFEs for the silliest of reasons...and once you get that RFE it does not matter if it is genuine or not....you have to respond and your case gets delayed.
I don't understand why members in this forum are so hopeful that if they are preadjudicated then it is a matter of time (and soon) they will get green.

My only point was... there is a reason they encourage $100 minimum for a one time contribution. They could have simply published the email id and opened the doors to $5/ $10 contributors... i.e. the folks who say they would happily contribute this small amount if they had that option.

Yes, I support excluding dependents from quota.
If you look at IV's agenda, most of the items benefit EB as a whole. The idea is to reduce number of people being part of quota. If you think in these terms, you should not have any problem in supporting "Exclusion of STEM grads" from regular quota.

it goes deeper than that. first let me point out that this is philosophical- you argument is not about law, it's about a point of view.
so if i ask you why EB2 filers should spend extra years getting educated and never getting this all important magic "PD" and then get in line behind someone who got a job the day they entered the country- and got a PD soon enough- what would you say?
ask me. it took me 11 years to get a PD. why? for 7 of those years i was getting my advanced education. so why should i suffer behind the 3 year Indian degree person (against my 7 years there as well) who came in 5 years after me and filed right away?
there are reasons why the EB priorities were set up. by simply extending your logic EB1 should also wait for a turn and not have priority. what's good for the goose....
having said that, it is absolutely insane to ask people to wait indefinitely and we must do something about it.
today the EB3 folks (and I have nothing against them, their waits are insane- and it's absolutely not right) are porting to EB2 with those bachelors degrees and 5 years experience. and just because they could APPLY for a GC earlier and all their years get counted in the PD, they keep lining up ahead of me. why do all my years count for NOTHING?
please spare us "fortunate" EB2s a thought too. think of when in life our careers are finally freed from waiting for a GC.
and now please concentrate on ways to end retrogression and stop the EB2 vs EB3 crap. we all have our problems.

A vast difference between these two categories at the last queue (485) does not make sense.

The IV's core team members deserve our unliimited thanks!
But it is also important to realize that what makes the IV great is each one of those thousands of members (and even guests) that kept visiting the site making this site so vibrant. It is this collective unity and the core team's ability to keep our focus on the right things that success has been achieved.
Not all problems have been solved yet (for example how long will it take to get EAD's, will we now be in another queue for several years, what about people in the BECs), and therefore this unity needs to remain as we go on to tackle newer challenges.
We can trust IV to keep this juggernaut going with support from all of us.

Not all problems have been solved yet (for example how long will it take to get EAD's, will we now be in another queue for several years, what about people in the BECs), and therefore this unity needs to remain as we go on to tackle newer challenges.
We can trust IV to keep this juggernaut going with support from all of us.

If my wife who is an MBA finance from Mumbai, currently working as a corporate banker with one of the top 5 banks in the world comes to the US on an H4 & decides to do a CPA certification, can she work on OPT until the H1B quota opens up next year???
